Loss of Permanent Residence Status
There are a number of
ways that permanent residence status can be lost.
Permanent residents risk
losing their status if:
- they have not spent
enough time in Canada - see
residency
requirement;

they are convicted of a crime - see
criminal
conviction;

they have not complied with a
condition under which they
obtained their
status, such as entrepreneurs who fail to open a business as they
promised - see
breach
of condition;

they obtained
status by relying upon a
misrepresentation - see
misrepresentation.
If an officer or a Board member does
determine that a person has lost their permanent residence status,
there is usually an opportunity to appeal that decision to the Immigration Appeal Division
(unless the loss of status is due to a serious criminality). If a person
is determined not to be a permanent resident, and does not make an
appeal, then the decision becomes final.
